IKWFC - Terms of Service

Welcome to Insane Kart Wi-Fi Connection (IKWFC), an alternative online service for Mario Kart Wii. By connecting to IKWFC servers or using services provided via our DNS, you automatically agree to these Terms of Service (ToS).

This agreement is between you and IKWFC and its developers. This document outlines the rules, enforcement policies, and user expectations while using our service. By accessing or using IKWFC, you acknowledge that you have read, understood, and agreed to be bound by these terms.

1. General Conduct Guidelines

All players are expected to follow good sportsmanship, show respect to others, and adhere to fair gameplay principles. Most rules align with those enforced on the Retro Wi-Fi Connection, with additional policies outlined below.

2. Prohibited Activities

The following actions are strictly prohibited on IKWFC and may result in disciplinary action, including temporary or permanent bans:

2.1 Cheating and Game Manipulation

Mass item hacks (e.g., infinite shocks or stars)
Speed modifications (minor or major)
Manipulation of item probability
Any other unauthorized advantages

Penalty: Immediate permanent ban without warning.

2.2 Server Manipulation

Starting other players' friend rooms without permission
Forcefully removing users from sessions without legitimate authority

Penalties:
First offense: 30-day ban
Subsequent offenses: Permanent ban
Ban evasion attempts: Permanent ban applied to all associated profiles

2.3 Network Security and Service Disruption

Scanning, probing, and intentional and unintentional disruption of services through unrelated and/or external means
Any attempts to compromise server infrastructure or security
Use of unauthorized tools or scripts that interfere with normal service operations

Penalties:
First offense: 30-day ban
Subsequent offenses: Permanent ban

2.4 Trolling and Disruptive Gameplay

Malicious gameplay behavior such as targeted attacks, trolling, or intentionally ruining the experience for others is not tolerated.

Penalty: Repeat offenses may lead to a permanent ban.

2.5 Inappropriate Mii Names (Mild Language)

Penalty: Temporary suspension ranging from 10 minutes to 30 minutes, at moderator discretion.

2.6 Offensive, Religious, Political, Or Activist Mii Names

IKWFC is a gaming community and not a platform for political or activist expression. Mii names that are deemed offensive, religious, political, or activist in nature will be subject to disciplinary action.

Penalties:
First offense: 7-day ban
Second offense: 30-day ban
Third offense: Permanent ban

2.7 Impersonation of Public Figures

Penalty: Repeat offenses may result in a permanent ban.

2.8 Emulator Lag

Policy: Continued participation with unplayable lag may result in removal until resolved.

2.9 Track Mismatch (Wrong Track Errors)

Penalties:
Accidental installation error: Up to 10-minute ban
Intentional misuse: Permanent ban

3. Service Updates and Changes

IKWFC may upgrade (patch) any software distributed through our service or change the Internet content of IKWFC, in part or in whole, at any time. However, any such upgrade or change will be for the benefit of users of IKWFC.

4. Intellectual Property

All IKWFC servers are based on reverse engineering or packet analysis of legitimate Nintendo WiiConnect24 files. All patchers, content creators, and scripts are protected by applicable intellectual property laws.

5. Enforcement and Moderator Discretion

Moderators reserve the right to apply or escalate punishments at their discretion based on context, severity, intent, and history of infractions. All decisions are made to protect the integrity of the server and ensure a fair environment.

6. Appeals and Disputes

If you believe a ban or disciplinary action was applied to your account unjustly, you may contact IKWFC staff through the appropriate appeal channels.

Note: If there is definitive proof of a violation, we reserve the right to deny appeals without further discussion.

7. Non-Assignability

You are responsible for use of your Wii console and IKWFC services by your friends and family. You may not assign this agreement to a third party.

8. Agreement Updates

IKWFC may change the terms and conditions of this agreement at any time as far as this is necessary or helpful to enhance the service or to adapt it to reflect changes in technical or legal requirements.

A current version of this agreement will always be available on our website. We will notify users about changes to this agreement at least 5 days before the change becomes official through our Discord server.

9. Agreement Interpretation

If any part of this agreement is found to be invalid or unenforceable, that part of the agreement will no longer apply. You agree that the invalid part will be considered deleted from the agreement, but that all other parts of the agreement will remain in effect. You further agree that we may replace the invalid part by a provision which reflects or comes closest to reflecting the initial intention.

10. Definitions

"Content" means the software and content, including applications and channels, which are available for use through IKWFC services.
"IKWFC" means the service whereby IKWFC can distribute software, material, e-mail and other data to your Wii console, and the Wii Message board of your Wii console, at any time and whereby you can send and receive e-mails, photographs and other material using your Wii console.
"Wii console" means Nintendo's system sold and marketed by Nintendo under the Wii brand, including any succeeding systems and compatible systems.
"Services" means IKWFC and any related services and material delivered to your Wii console over the Internet, including but not limited to Content and messaging services.
